The electronic communications market in Gibraltar is regulated by the Gibraltar Regulatory Authority (GRA), who has designated Gibtelecom as having a significant market power in the various EU defined communication markets. Consequently, the GRA has imposed certain obligations on Gibtelecom, which include transparency, non-discrimination and price controls, amongst others.

Gibtelecom provides a Reference Interconnect Offer (RIO) to connect to Gibtelecom's fixed and mobile networks.

Gibtelecom's Reference Leased Line Offer (“Agreement”), which is presented in the form of a standard contract, deals with specific national Wholesale Leased Line Services which Gibtelecom offers to operators authorised under the Communications Act 2006, operating in the Gibraltar market.

These public consultations allow operators and other interested parties to answer a series of questions which the GRA takes into account when publishing its decision. GRA Public Consultations - Market Analyses

The Communications Act 2006, transposing the 2003 EU set of Communications Directives, and now amended by the Communications (Amendment) Regulations of 2011, requires the Gibraltar Regulatory Authority (GRA) to carry out Market Analyses to ascertain the state of the communications market in Gibraltar.

During 2007, Gibtelecom submitted responses to the three extensive Market Analysis Public Consultation reports issued by the Gibraltar Regulatory Authority.

The consultations, which were issued by the GRA on 10 April 2007, were the culmination of a set of comprehensive analyses on the state of the local telecommunications market and which were initiated last year. The analyses are a requirement of the Communications Act 2006, which was implemented in June 2006 and transposed the 2003 EU Communications Framework.

In each report, Gibtelecom is being designated as having Significant Market Power (SMP) in the defined markets and a set of obligations, or ‘remedies’ are being applied in each. The remedies, which are only applied to SMP-designated operators, can vary from price control to applying policies of non-discrimination to price publication and accounting separation.

The GRA issued a further public consultation in June 2009 assigning SMP on CTS (Gibraltar) Ltd in their own fixed and mobile networks. Gibtelecom submitted a response to this public consultation.

In 2011, the GRA issued public consultations on its second round of market analyses. In each consultation, the GRA proposes to maintain the SMP status on Gibtelecom. Gibtelecom submitted substantive responses to each public consultation.

GRA Public Consultations - Network termination points

The Gibraltar Regulatory Authority (GRA) issued on 7 April 2008 a Public Consultation document addressing Network Termination Points (NTP). The document sought interested parties’ views as to whether there is a need for the GRA to further define NTPs and the location of these within a network. In addition, the GRA is also seeking to assess whether access to in-building wirings should be made available to other operators, including making these available at set prices.

GRA public consultations - Retail price controls

The Gibraltar Regulatory Authority (GRA) issued on 11 August 2008 a Public Consultation document addressing Retail Price Control - Application of rebalancing and a price cap control on Gibtelecom. The document is a continuation of the Market Analyses consultations initiated in 2007 and sought interested parties’ views on the application of certain price control mechanisms on Gibtelecom.

Gibtelecom's submission reiterated the Company's position that it should be allowed to complete the tariff rebalancing exercise started over seven years ago prior to any price cap or other form of price regulation. This view is supported by EU telecommunications law as rebalancing is a requirement and prerequisite to full liberalisation in a telecommunications market.

Gibtelecom also question some GRA proposals for fixed broadband access and services. Gibtelecom states that this market has not been defined by the GRA as part of the Market Analyses process and should therefore not be subject to retail fixed price controls.

On 26 April 2010 the GRA issued a follow-up consultation addressing and clarifying the compliance requirements of the retail price controls.

GRA Public Consultations - Universal Service Obligations

The Gibraltar Regulatory Authority issued public consultation 04/09 on 11 June 2009 on the designation of universal service provider. The GRA’s proposals designate Gibtelecom as universal service provider for a period of three years ending 30 September 2012.

GRA Public Consultations - Accounting Separation

The Gibraltar Regulatory Authority (GRA) issued on 30 September 2010 a Public Consultation document addressing Accounting Separation and Cost Accounting Systems – Compliance under SMP obligations. This public consultation deals with the GRA’s position with regard to accounting separation and cost accounting obligations and compliance of relevance to Decisions 03/08; 04/08 and 05/08 on Market Reviews published 11th August 2008 and builds upon Statement No. 07/08 on Accounting Separation, Cost Orientation, Cost Accounting methods and compliance under SMP Obligations.

GRA Public Consultations - Number portability

On 7 February 2012 the GRA issued Direction A01/2012 amending Direction A01/2010 on number portability. The new Direction removes the previous GRA requirement to host the number portability database in Gibraltar. As part of correspondence leading up to the publication of Direction A01/2012, Gibtelecom had submitted comments as to whether moving the database outside Gibraltar was the right approach.
